    I agree. My first LE employment prior to becoming a Police Officer, circa 1970's, was as a Peace Officer. At that time if you were a Police Officer you were also a peace officer and vise versa in some cases. It all changed around 1980.

    no one, including me is saying they can't enforce NYS Law. Most peace officers have special duties. They receive training geared to those duties. Sometimes their special duties, which require certication are similar or identical to Police Officers.

    So so in theory, NYS allows a peace officer...

    RE-READ the post. The LEO whether peace or police can make the stop. You don't need a degree in rocket science to see the sheriff was playing cop. He probably felt dissed when the off duty passed his car, if that's what happened. Once he identified the OD, it should have been, have a nice day, be safe....

    One has to look at the totality of the stop. In this case the NYC Sheriff is not acting pursuient to his special duties. If I'm not mistaken, they are neither trained or certified to conduct speed enforcement. For the deputy to even-initiate the car stop for speed, absent any other violation or crime...

    First, what job are you on? If you are a police officer and though the "sheriff" was in uniform and you in civies, he is only a peace officer. Again, you should know that and you should also know they don't and can't write speeds. I believe TBTA, also peace officers are the only agency trained...
