If the off duty is in fact “off duty”, then wouldn’t the swearing be protected speech, protected by 1A just like any other citizen?
On duty can request professional standards (or equivalent internal department) to investigate, but in the end, I don’t see where there is anything actionable for the on duty to act upon.

Just watched the video. Seems the on duty was a bit preemptive. Off duty requested sergeant. Why not wait until the sergeant arrived on scene before going hands on?
Didn’t seem like there were any other pressing issues that would require escalation of the situation.
Love the way the wife hops in there during the hands on and says “We know the law”.
Something tells me there’s a lot more to this incident.
