  • Here is my familes personal situation...

This is going to take a while to explain so bear with me... Any suggestions would be helpful.

I have a neighbor that lives across the street from my Mom's house. My 16 year old Brother lives there with her. The neighbor was friends with my Mom at one point until she realized they were a little out there in more than one way. Long story short, they accused me of doing something I had not done. My Mom and Brother witnessed what really had occured, etc. They approached my Mom and she has very little tolerance to controlling men. IE: Divorced, was abused, etc. Anyways, she yelled back at the neighbor. Ever since, they call the Police for EVERYTHING. We live in the Country and on 1.5 acres.

The calls have been from running a snowmobile within the city ord., to shooting a BB gun at rodents near my Moms bird feeder. What gets me the most is they know I am a PO and they have seen the squad in the driveway when I was in the area for training, vs. staying at a hotel. I was even accused of vandalizing their vehicle. I laughed, dont get me wrong. I luckily was at a casino with the wife for the night it happened and stayed at the hotel so proof wasnt hard.

This weekend they called again for running a snowmobile at 20:15 hours. The PO came out and spoke to the three of us. (Mind you, I was a reserve officer for the PD so they all KNOW me WELL). We have never ever been cited, let alone even a verbal warning. He actually had a hard time keeping his composure. My Mom was ****ed and freaking out.

They do things to break the law themselves but I am not going to use the police to get even. They rent the house and have been for two years. I've been tempted to express my concerns to the landlord, but I am at a loss.

The PO and Chief are very well aware of the situation. They even use other neighbors names when they call. I know this because they tell me and I am close with those neighbors and they say otherwise. Esp, when their kids do far worse.

I had been threatened at one point before all of this really took off and I did not do anything about it.

What to do? My boiling point is about there... Esp. when they are F*ing with my Family, my Brother, etc.

Buy adequate mufflers? I don't see how disturbing the neighbors has anything to do with you being a PO or not. If you can't talk to your neighbors and resolve problems then you have to have profesional intermediaries to be go-betweens.

Stop being a wuss. You have a badge, use it for what it was meant for: protecting innocent persons from someone who is breaking the law. Just because the victims are you and your family, that doesn't mean that you don't deserve the same protection under the law that everyone else deserves.
In Colorado it is a criminal act to file a false report (18.8.111 C.R.S.), I'm sure they have something similar where you live.
        Nail her arse.
And get your brother out of her house. That's just weird. Ship him off with social services if you have to.

16 and living with mom is not ok?

In any case, yea they have crossed the line. Just treat it (your family) as if it was any other family and take care of business

It read to me that he's living with the neighbor (I've seen weirder); but you're right, he's probably with mom.

Nope, my Brother is 16 and lives with my Mom. Nothing weird there... I live 2 hours south, but visit once a month for a weekend or week.

They do abuse the 911 calls but I don't see how a restraining order will do any good when I've already had a buddy of mine (LE) serve them a trespass order so they know what will happen if they step into my Mom's yard.

The snowmobile was being ran to drive it off of the trailer into the garage to be worked on / tuned up. The funny thing is when the PO were called this last time with the sled at 20:15 hours, the neighbor next to us, his kids were 4-wheeling around the yard, two doors down, they were dirt biking, as the Officer was at our house. That is why he was laughing about how our sled would annoy them, but the dirt bikes and 4-wheeler would not.

Because a restraining order prohibits harassing, including via third party, and you can't use law enforcement to violate one.

let me speak from my expereience, Here in Mn we (leo) are second class citizens. Most judges in my area will not apply the laws to LEOS the same as they do too Joe Sh##bag. I even had one judge outright tell me -"will you are a public figure" and you should expect some harrassment. I explained that yes, I expect some I did not believe my Wife and kids needed to be subjected to it. Basicaly in MN LEOs are treated like sh## from the citizens, Criminal justice system. That and Mn has some of the most f***ed up laws around.

Well, if MN is anything like NJ, a restraining order COULD NOT be obtained. Restraining orders are only to protect those from Domestic Violence. Personally, I would have your mother or you file a harassment report everytime idiot calls on you. Eventually the judge will get tired of seeing you and impose a significant fine or community service to make them stop bothering you.
Being a good street cop is like coming to work in a wet suit and peeing in your pants. It's a nice warm feeling, but you're the only one who knows anything has happened.

When the police come do you stop doing what you were doing or continue on?

A dog barks at a mail man because he comes and the dog barks and he leaves, the dog does not understand that he did not leave because of the barking. So the dog learns that he chases away the mailman when he barks. If the mail man came and dog barked and the mail man came in for dinner and stayed the dog would not bark.

If the police come and you stop what you were doing, then of course the neighbor calls the police again, because it works.

What I don't understand is why the PD is tolerating this nonsense? After a couple of bogus calls making illogical and unfounded complaints, the PD should be acting against the POS neighbor.

Warn and advise of the probability of a harassment complaint being filed against them, unlawful use of 9-1-1, etc. Talk to the bosses and ascertain what is going on. You may find things will go your way.
Be courteous to all, but intimate with few, and let those few be well tried before you give them your confidence!

True -- a good insight, and a good analogy for many situations.

No, I usually do not stop what I was org. doing. They called one morning for putting the sled onto the trailer at 7am, which was legal, but I did not have any others to do, so in a sense, I did stop. The past time, I ran the sled, etc... When the Officer left, I fired it up again because I was not breaking any laws. Then I decided to make sure all of my other 4 sleds would start so I had all 5 idling for about ten mins.

So you run 5 motors at 7:00 AM. You don't think your neighbors should take umbrage at that? I would be quite annoyed.
