Funny how the article never mentions the fact that the firearm was being declared. They make it sound as if he strolled into the airport armed and was arrested after it was found.

It would be a good case to fight since he appears to have a clean record. In NY you can only have a gun if you are a resident.....since when does your Constitutional Rights end when you cross state lines?

I don't see how it can be constitutional to arrest someone who is legally transporting a firearm. Carrying is one thing, but unloaded, declared, and made safe to transport from one state to the other is something else. NY is ridiculous.

What about federal law that allows interstate travel with firearms... if he started his journey where the gun was legal, and is ending his journey where the gun is legal, isn't the transport of the gun through NY also legal?

Well New York keeps electing the same *** clowns year after year to represent them so I don't have a lot of compassion for the people of the state. As is often said, you get what you deserve.
As for Roberto Guerrero it sucks but honestly by now doesn't everyone know New York's view of private citizens that own firearms? It's not like they've tried to keep it secret. I don't know much about them, but you can bet your life I'd spend some time finding out before I ever considered having a gun (or any other weapon) anywhere in the state of New York.

Pretty messed up when you get more jail time for possession of a firearm than for actually committing a violent crime with one.
So glad that I don't live in a state that is so hostile to the Bill of Rights!

I hope that someday people can have legally carried guns in every state and not get arrested for it.
This guy is famous, he's boxing Floyd Mayweather next, so we'll see where this goes. This could be a good case for the courts perhaps. He declared his unloaded gun when he arrived at check-in.
I'd say they can charge him with at least two things, the gun and the 15 round mags which are against the SAFE Act.

Robert Guerrero Reportedly Arrested at JFK Airport for Gun Possession

Boxer Robert Guerrero was arrested Thursday morning for gun possession at John F. Kennedy International Airport in New York City, reports Joe Kemp of the New York Daily News.
According to BoxingScene.com, Brown told reporters that bringing an unloaded weapon into the county is a Class E felony. The boxer brought a .40 caliber handgun and three 15-round magazines into New York, and told authorities at the airport where he was arrested that he had them. He now faces one count of criminal possession of a firearm and three counts of third-degree criminal possession of a weapon, a combination of felony charges that could see him facing up to four years in prison.
Guerrero is scheduled to face Floyd Mayweather Jr. on May 4 in a welterweight title bout. He was en route to Las Vegas, the location of the fight, when he was found in possession of a firearm at the airport and placed under arrested, according to the report.
