    Dallas Police Officer Arrested

Dallas Police Officer Arrested | NBC 5 Dallas-Fort Worth

A Dallas police officer is on administrative leave after being arrested in Mesquite. He's also accused of firing a shot into another car.

According to a statement from Bill Hedgpeth of the Mesquite Police Department, off-duty Dallas Officer Rafael Mendoza was taken into custody early Sunday Morning.

"At about 2:40am Sunday morning, Mesquite Police responded to a “person with a gun” call in the area of IH-30 and Big Town. A caller said that a person traveling eastbound on IH-30 was holding a gun out of the driver’s side window."

The vehicle was located near I-30 and Northwest Highway.

"The driver appeared to be intoxicated and after field sobriety tests were conducted, he was arrested." the statement said. "A handgun was recovered at the scene and a small amount of marijuana was also located in the vehicle."

Officer Mendoza was taken into custody. He is charged with Aggravated Assault with a Deadly Weapon, Driving While Intoxicated and Possession of Marijuana under two ounces.

A second caller told police that the driver of vehicle matching Mendoza's fired a bullet into the trunk of his car.

The Dallas Police Department also released a statement.

"Officer Mendoza is assigned to the Northeast Patrol Division and has been employed by the Dallas Police Department since December of 2008. In addition to the criminal charges, an administrative investigation will be conducted by the Department’s Internal Affairs Division."

Dallas Police would only say Mendoza is on administrative leave while an internal affairs investigation takes place. As of Sunday evening, he was being held at Lew Sterritt, on $26,000 bond.

In August of 2011, NBC 5 reported Mendoza's arrest for domestic assault and unlawful restraint.

His former neighbor David Leon remembers seeing Mendoza fighting with a girlfriend at the time.
Leon lived across from Mendoza up until a few months ago. He described the scene he says unfolded outside their apartment building just east of downtown Dallas.

"She was screaming, and he was shaking her, and I was like man he’s a police officer what can you do?" Leon explained. "All that screaming she put up, it sounded like it was hurting."

At my department if your arrested your immediately fired and unemployeed before you even get into booking! Im amazed reading stories on here where they are kept on board in some fashion until the investigation is over. Here you are fired and if you are found not guilty you can apply again and 'may' get hired.

          Really?

With no consideration for the charges or possibility of innocence?

The legal system has to treat you as innocent until proven otherwise. Your employer doesn't.

I agree that one should get the benefit of the doubt with the way some prosecutors can be. This officer, however, seems to have a history. Add possession of a controlled substance and I can't imagine why he'd be on administrative leave, especially if he's currently in a jail cell.

This is why unionization is good. Nobody should be fired until found they're found guilty.

                  Exactly.

You get fired, lose your house and car an then they say, "Oops, your innocent. Sorry."

The same is true for just about any profession. Either a union, or an employment contract individually can save you.

So can a wrongful termination suit, but of course that's chasing from behind instead of being ahead of the game.

Uuuhhh, why wasn't he fired for this when it happened? Sounds like DV to me.

Federal law prohibits those convicted of domestic violence from possession of a firearm, so I assume the charges didn't stick, somehow.

I don't agree entirely. Even in a union environment the standard is probably only a preponderance of the evidence, not guilt beyond a reasonable doubt. If the officer is acquitted at trial because the state couldn't meet that high burden but an investigation showed misconduct by a preponderance, I am all for the person being fired. I mean, what if the officer was caught with dope but it turned out that the search was illegal and therefore the case had to be tossed? Should he still keep his job?
