    RICHMOND, Va. (AP) - A federal judge on Tuesday strongly urged the ACLU of Virginia and the Richmond Police Department to settle a dispute over payment for traffic control at a protest march planned for this weekend.

    Police have told May Day parade organizers they cannot march through city streets unless they pay $294 for the use of two patrol cars and two off-duty officers to serve as police escorts. The loosely organized coalition of worker-rights activists estimates about 200 people will march in the Sunday afternoon event.

    The ACLU, which represents the organizers, says the city's parade permit ordinance provides no authority for charging for police escorts. Allowing police to require payment without clear guidelines raises the possibility of discrimination based on the content of the protesters' speech, ACLU of Virginia legal director Rebecca Glenberg told U.S. District Judge Henry E. Hudson.

    Deputy City Attorney Brian Telfair disagreed.

    "This has nothing to do with the First Amendment and everything to do with public safety," he said, noting that the parade organizers plan to walk down the middle of some of the city's busiest streets and through 21 intersections.

    The ACLU and its clients are seeking an injunction allowing the parade to go on without any payment, which the organizers say they cannot afford.

    Hudson did not sound sympathetic to the parade organizers' dilemma, noting that the ACLU had already declined his suggestion to meet with city officials and try to work out a compromise.

    "My impression is these people want to accommodate your client," Hudson told Glenberg. "You can't have 200 people walk down the street without a police escort. That's just common sense."

    Glenberg replied: "No one is saying they can't provide the police protection _ it's just who pays for it."

    Hudson renewed his suggestion that the parties work something out and said he will have a decision by noon Thursday if they don't.

    After the hearing, Glenberg declined to say whether she and her client would take Hudson's suggestion or just wait for his ruling.

    Last year, police provided escorts for the May Day march along a less heavily traveled route at no charge. Richmond Police Maj. Michael Shamus testified that someone in the city administration directed police to waive the fees. Two years ago, he said, police provided traffic control for an "impromptu" parade by the same group.

    Telfair said the protesters can march on the sidewalk without a permit, but lead organizer Kenneth Yates testified that sidewalks are too narrow to safely accommodate the throng and its signs and banners.
