  • Caselaw similar to Mimms vs Pa...

Does anyone know the case law from 1997 that is similar to Mimms vs Pa. regarding our ability to make drivers and passengers exit vehicles while on a stop? Thanks.

      Most recently:

      Arizona v. Johnson,
      129 S. Ct. 781 (2009)

"The Supreme Court noted that consistent with previous rulings, a passenger in a vehicle stopped is seized within the meaning of the Fourth Amendment, just as the driver is seized, at the initiation of the stop and until it is over and that the passenger is not free to end the encounter or move about as he wishes."

Based on this, you can order a driver or passenger to exit a vehicle based on reasonable suspicion, officer safety issues, etc.
