If there is evidence of a large number of blows, I can imagine an argument that they beat him for too long, which is what caused the death.
In addition, Florida law (like the law of most states) may require that the suspect enter or attempt to enter the residence before the use of deadly force is justified. There is nothing in the article to indicate that such an attempt was made. To the contrary, the article refers to the suspect as a "prowler."Last edited by DAL; 09-11-2009, 03:44 PM.

Florida's castle law allows residents to protect themselves and their property if they feel threatened.

A prowler who jumped over a gate to a Miami home died after he was confronted by the homeowner and the homeowner's son Thursday morning.
The incident happened around 12:30 a.m. at a home located at 2245 S.W. 31st Ave.
Miami police said the suspect, 23-year-old Cristobal Navarra, jumped over a 6-foot fence. When the homeowner, 45-year-old Juan Carlos Kennedy Sr. heard a noise, he went to investigate. Kennedy's son, 19-year-old Juan Carlos Kennedy Sr., went outside to help his father.
Police said Navarra was beaten with a golf club and died.
"Obviously, the family is extremely distraught with what occurred. They are very emotional and upset, as you can imagine," said attorney David Kubiliun. "Unfortunately, the person has lost their life, but at the same time, the law does protect a person to defend his property."
The attorney for the family said the home has been targeted four times before, once by an armed robber.
Detectives interviewed the Kennedy and his son, who would not comment to media about the incident.
Neighbors said they agree with the man's action.
"It’s great,†said neighbor Orly Gonzalez.
Gonzalez told Local10’s Kellie Butler there have been a number of burglaries in the neighborhood recently, and he is glad his neighbors took matters into their own hands.
"You need to save your life. I'd do the same thing," said neighbor Isis Telles.
