    STOCKTON, Calif.—A witness says a man shot dead by California Highway Patrol officers was not charging the officers with his truck as they allege.
    According to the CHP, officers shot 21-year-old Joseph Pinasco after he ignored their warnings to stop and then charged them with the truck early Sunday morning. The confrontation followed a short chase when officers tried to pull Pinasco over for driving erratically.

    But Geri Wade, who lives on the rural road where the shooting occurred, says Pinasco's truck was stuck between a fence and a ditch and the officers "did not give him one second of a chance."

    The incident is under investigation, and the officers have been placed on administrative leave.

    STOCKTON (AP) ― The California Highway Patrol is investigating the fatal shooting of a man who officers say revved his engine and drove toward them in his truck.

    21-year-old Joseph Pinasco of Stockton died at the scene Sunday.

    According to investigators, CHP officers were responding to calls of possible street racing when they spotted a truck going erratically near Highway 4.

    After a short chase, the driver lost control and the truck spun around to face the two officers, who drew their guns and ordered the driver to stop.

    Investigators say he accelerated toward them and the officers opened fire.

    A CHP spokesman says it's unlikely Pinasco had been involved in
    the racing.

    Really? Seems if there was a "chase" there was more then "one second of a chance" to give up.

      And I'm sure this "witness" is a fine upstanding member of society with no anti law enforcement agenda.

        A bystander giving a different version of events?!!....I'm SHOCKED....appalled even......

        This NEVER happens with our OIS incidents.....

          Peoples views and how they express what they see are influenced by their own personal biases. For example..... the vehicle code says it is a violation to refuse to comply with an order from an officer yet some in the general public still seems to believe they can disobey an order repeatedly as long as they eventually comply they are ok and no law is broken because the police are supposed to put up with that.

          The other thing to consider is that you can have 10 people view something and get 10 different accounts of what happened. I would like to know exactly how far away this witness was.

            Without video I guess we will never know.

            If the truck WAS stuck and the guy was just revving his engine, would it still be grounds to open fire? The intent to drive towards the officers would be there, but not the ability.. hmm

              Alot would depend on the individual officers' mindset at the time.....if they BELIEVED he was trying to drive towards them (by hearing the revving engine, maybe dirt flying up from the spinning wheels ect), then they could be justified in firing.....

                It seems to me that we have been hearing of more shootings by the CHP in the last year or two. Are they up, of is it just the result of more publicity?

                  I really do not believe there are more OIS involving CHP officers than in the past. I do believe, however, that with the sensitivity of the media concerning OIS there are more stories being published about all agencies and OIS.

                  There is also a factor out there in the public spaces that do not care for any LEOs and they have easier access to all types of weapons. This factor includes a massive youth group that has grown up with all types of violent video games. And, that youth factor does not truly understand the consequences of their actions concerning the finality of death. All they know is that they play the games, turn them off and back on again only to be faced with the same foe that were killed off earlier.

                  Just before I retired we were noticing an increase in the numbers of young teens - 13, 14, 15 and 16 that were carrying guns and using them without the slightest remorse until they got caught.

                  There is a small element of humanity that believes they are truly an untouchable group and will use their vehicles as weapons in attempts to get the police to back down. That element is learning the hard way that a two ton vehicle is a physical threat to others and they are being shot for their stupidity.

                  All officers, including the CHP, are taught that they are never to place themselves in a position of vulnerability or attack. That includes standing directly in front of or directly behind a vehicle; and, most officers practice that defensive action. However, the drivers are deliberately swerving towards the officers in their attempts to escape. Again, as above, they are being shot.

                  Is it any wonder that motorists who do not use their heads are getting shot?

                    Please stop attacking individual users and turning a free forum for General Law Enforcement Topics into a personal insult-fest.

                    While I will admit that it is possible that the witness is correct, it is unlikely.

                    I think there is small chance the witness is correct. I think there is a much larger chance that the witness saw part of the event (or maybe heard the gunshots then turned to look), then filled in the blanks however they felt was best.
