    When I first read that article, a while ago, my first thought was okay, here we go again, another Chicago cop had too much to drink and got into a brawl where the victim was just a victim. And, that was probably the cause for the over-reaction of the Iowa prosecutors. I would say that there was definitely an overly enthusiastic prosecution of the officer and the punishment is certainly not befitting of the circumstances. Tragic all the way around. But, when things happen out of state, you have to live by their rules.

      The law of assault varies from state to state. In many states, the victim of an assault is required to retreat if it is safe to do so. I do not think that any states follow that rule when a law-enforcement officer is assaulted. However, Mette was not a law-enforcement officer performing his duties. He was just visiting Iowa for personal reasons.

            If you want to protect your job, you go the other way when you've been "pushed three times." "Fracturing his nose, cheek and jaw" is quite "a punch" and I'm assuming the prosecutor read it as him becoming the aggressor over a staggering drunk, not the defender.

            I agree, bad news all around, but this didn't have to happen.
