A friend of mind attends bdsm parties in houston, texas and at these parties people consent to being hit with canes, paddles, gloves and zapped with electric devices. sex is also permitted at these parties. my question is.....these parties are held in private homes and an admission fee is charged. since sex is allowed and a fee was paid, does this constitute prostitution? not everybody has sex but a majority do.

To have a clear-cut case of prostitution, money would have to be exchanged for sex. This sounds more like there is a cover charge, and people who want to have sex do so without compensation.

Chances are that Houston has an ordinance that would prohibit charging for admission or food or beverages at parties at private residences. That could be enforced to shut down the party.

Back when I worked Hollywood, there were similar homes and clubs for swingers. Vice worked them, but usually left "empty-handed".

If I may hazard a guess on this --

It would seem to me that in order for there to be prostitution, there would have to be

1) a distinction between the persons coming to the party for the sole purpose of having sex and the persons who are present to provide it (which one is the prostitute and which one is the "john" [or "jane"]);

2) The persons performing requested sex acts would have to receive a cut of the admissions charge.

That's just a guess.

I, too, have a friend (back in L.A., CA) involved in what BDSM folks call "the scene." He's told me that what most of us consider as sex, is not allowed in BDSM clubs, in order to keep LE from having to take actions against members.

You want to get flogged, wear a dog collar and walk on all fours, be tied up and spanked, or serve up such acts, it's all okay....but the moment sex happens, you can be busted.
