    Hi, I was applied for Lasd and I passed the written test , the oral test, , the polygraph, and I got to the background investigation part and everything was going great I even have a family friend who out of coincidence my BI and him actually worked together they talked about me and had a good conversation about me then I get a letter saying I was not selected for the CA position because sexual misconduct I honestly dont even know how they came to that conclusion and im going to appeal I guess what im asking is there any chance that the decision will be overturned and will I found out how they came to that outcome im nervous that I was doing so well and its all over

    My conclusion is that there is something else to it. Say for instance, your really poor concept of sentence structure.

      There is something crucial you are leaving out. You can't tell me that they pinned you for sexual misconduct and you're absolutely clueless as to how that was determined.

        The forms i filled out asked if I had sex with a girl that was 3 years younger than me I said yes/no I was 17 and she was 14 we didnt have sex but we did things like touch and kiss and that's all then my polygraph examiner asked if I watched porn I said yes and if I had sex in a car i said twice with my girlfriend at the time who was 17 and I was 18 but she was turning 18 that same year my examiner made it seem like everything wasnt a big deal but I guess it was

              I don't know California law well but I BELIEVE that sex with the 17 yr old is most likely your problem----

              As well as the doing sexual acts with a 14 yr old------------------

              In California, there is a crime of "Unlawful sexual intercourse", which is an act of sexual intercourse with a person under the age of 18 who is not the spouse of the person. (CA Penal Code § 265.1 (a))

                    Wow I wish I knew that because I never would have done it ! So what do you think of an appeal. Any advice of how I should go about it?

                      I would say an appeal would be fruitless--------------but I am not looking for a job and trying to get hired.

                        That was just so IF he was hired, they'd know which direction to point the dash cams for the web feed. It's embarrassing when the guy turns out to be more of a "hood" guy than an "in the car" guy - or vice versa - and the cams pointed the wrong direction.

                          Time and distance from the event should help too. Unless there was a trend of course. I feel if it was a one time thing when u were in high school and your now in your upper 20s, married, and nothing else "sexual" is in your background it shouldn't be a big deal. Thats just my opinion thought. We were all dumb teenagers at one point.

                            Dumb teenager is not an excuse.
                            I'll also bet there is more there than the OP posted.
                            There is no appeal unless misconduct on the part of the agency is proven.

                              a 17 year old admitting to basically fondling a 14 year old doesnt help either,thats kinda like a junior in high school with a junior high girl.
