    No Weapons Allowed!

    I went to go see a movie today and as I was walking in the door and I saw a very interesting sign, “no weapons allowed”, and it had a picture of a hand gun with a red X through it. Thought that this was kind of odd but shrugged it off, but then it got me thinking. I don’t think this sign applied to LE but I still want to ask this question. If you are going somewhere and they have this sign up and you are carrying concealed and they knew about it, could they refuse to let you in? I know that carrying concealed means no one is supposed to know it’s there but let’s just say they know that you have your gun on you and refuse to let you in. Can they do this? Has something like this happened to you before? What would you do if someone refused to let you in because you were a cop and carrying your gun off duty?

    BTW this happened in Southern California.

    Yes, private businesses and property owners are allowed to control who if anyone carries firearms on their property. I have never had a problem as most places would never even know I'm carrying.

      agreed. a person has the right to decide what is brought onto their property, unless you're on duty and acting in your official capacity.

      that said, i've seen the sign (theatre) too. i assumed it didn't apply to me, even when i wasn't in LE :-)

        Dodger Stadium, Disney Land, Magic Mountain to name a few major places in LA off duty LEOs can't carry a gun. Private property, their rules

          All they can do is refuse you entry or have you leave if you are already there. There's no criminal violation. But it is their place, and they can state their rules for doing business there. You can always call and ask if their intent is only toward the general publics weapons, or if they do not want LE to carry there either.

            Interesting. In Kentucky, state law specifically authorizes peace officers to carry concealed anywhere in the Commonwealth. I interpret this to mean an officer can carry anywhere, regardless of the private owner's signage.
            My posts are sometimes educated, sometimes informed, and sometimes blowing smoke...but they are mine and mine alone and do not reflect on anyone else (especially my employer).

              You can, but you can also be told to leave by the property owner if they find out you are carrying and don't want you to do so on their property.

                Your question has been pretty well answered. The owner of private property has the right to determine whether or not, anyone, including off-duty LE Officers can carry a weapon on their property. Notice that I said off-duty. As has been noted, an Officer on duty, and acting in his/her official capacity, can enter private property armed, regardless of the owner's preference. I'm retired, but am authorized to carry under provisions of HR 218. My feeling is simply this. A venue that doesn't allow an Officer, active/retired to carry on his property is acting well within his rights. I'm well within my rights in taking my business elsewhere. It's a "win-win" across the board. He gets his way, I get mine. IMHO.

                      In Ohio those signs only apply too civilian concealed carry permits. Last time I checked my oath of office didn't expire when I took off my uniform. Besides Wal mart has those signs on the door. Do you know how many knuckleheads I have arrested and then seen them and or their extended family members at walmart? You think I am going in unarmed? Yeah and I got a bridge to sell you too..

                        Not true. Ohio's CCW law specifically states that off-duty LEO's are considered CCW permit-holders, no more no less, and that all the same rules apply...including the stupid little signs. There's no special stipulation for LEO's in the CCW law. Now, if you're within your jurisdiction and carrying CCW, you may (or may not) be able to get it to fly that you're a sworn officer within your jurisdiction with full arrest powers, in uniform or not. Outside of your jurisdiction, you're out of luck (under the letter of the state law, at least).

                            Bottomline, sure private business can ask you not to carry but it is not illegal for off duty L.E. to do so and they can't do anything about it except as you to leave their property. Read up on the Police Officers safety act that Bush signed into law, it will explain it and it's a federal law that supercedes any retarded local or state law such as the retarded "sullivan act" etc..
