    Looks like things are different in various states.
    If the mgr told someone to leave and not come back, then returning there would be trespassing.

    Yes, they can ban anyone whom they desire without reason, and if the person returns they are guilty of criminal trespass.

    Here are a couple of facts for you to take into consideration. A manager, acting as "agent" for the owner of any property, can validly ask, or require any person to leave the property. If the store owes your "friend" money, they cannot deny that to him. However, they can send the check in the mail, or require him to come back for the check on a normal payday.

    Irish-here the verbal is enough for a warrant on second degree trespass...HOWEVER, if PD is called we issue a little trespass warning (which is the same documentation we do field interviews on, just check FI instead of trespass) so that there is documentation and same is entered into the CAD and computer. If we come back and he's there, we take him to jail...if we come back and he's already gone, the manager would have to go to the mags and get a warrant. But, that's just NC.

    Here the manager would have every right in the world to do that. Since he didn't have the police come by and tell your friend he wasn't to come back the first time, your friend probably wouldn't get in trouble if he went back that one time.

    Here we don't really have a 'trespass notice'. Basically someone from the store (doesn't have to be the owner, it can be a manager) tells them they're not allowed to come back in our presence. We don't really give anyone any paperwork, but we do do a short narrative for our records.

    If we get called back to the place for the same person being there, we just check our records to make sure they're still trespassed. If they are still trespassed, they get arrested on the spot no questions asked. Tell your friend not to be stupid (I'm not saying he is stupid, just saying that going back and getting arrested would be stupid). I can understand still having friends that work there, but hang out with them at a different time.

    In addition to FNA's post there are tons of different video rental establishments that your friend could frequent. What about Blockbuster Online? It just sounds like he is only concerned about hanging around the store with friends and FNA covered that nicely.

    Let's see.

    The manager of the store told your friend to stay out.

    If your friend goes back and the manager calls the police, your friend will be escorted out and told not to return. When, and if, your friend decides to do so, he'll likely have a problem. But, with the screen name "COPS", you should know that.

    Your friend wants to "hang out" in the store talking to other employees.

    As a helpful hint and a life-lesson, it's not really appropriate for your friend to "hang around" a place of business distracting the employees which ultimately may cause your friend's friends to lose their jobs.

    Gotta back it up with paperwork or it doesnt mean a thing.

    In other words, if he gos back to the store the managers only recourse is to ask him to leave again, unless a tresspass notice was issued. At that point there is a record and charges can be sought.

    Thats how it is where i am at anyways. Check your local ordinances and state law. They keep them in the library. Thats the palce with all the books. Not Borders.

    A store owner, like a home owner, can have anyone they'd like banned from their store. Because they own the property, they can determine who does and does not come upon it. In his case, there's several Blockbusters around that he could go to, so he's not suffering too big of a loss.
