    Several kids seen sucking in computer air duster cleaner. All cited and released. Should they have been arrested ?

    Cite was for 381(b) PC

    Sounds like it's just a misdemeanor in which case they can be cited and released.

      Not a whole lot of info in that question you ask. Should they have been arrested.....they were and then released with a misdemeanor cite. If you are asking if they should have been physically taken into custody that is another question. How old were they? Were they under the influence and unable to rationally care for themselves? What time was it?

        Thanks for the feedback. I forgot to mention this was in CA. Should they have been taken into custody was more of what I am looking for. They were between 16-18. Daytime. They appeared to be able to care for themselves. The adults were released and the juvs were picked up by their parents.

          That is exactly what should have happened. Cite the juvies and release them to the parents. Juvenile Hall is not going to accept them with that charge. They will go to juvenile court later for the charges, the parents now have custody of them and the problem has been temporarily solved....best case scenario has happened.

            Juvs are given NTA'S and released to their parents. Juv hall won't take them.
            This profession is not for people looking for positive reinforcement from the public. Very often it can be a thankless job and you can't desire accolades, because those are not usually forthcoming. Just do your job to the best of your ability and live with the decisions you've made.

              381 A and B can be for either possession of the substance or being UTI. Assuming they were UTI... Juvie Hall isn't an option at all here. Our Hall won't accept any kids who has used alcohol or drugs in the last 24 hours. They get dumped at a hospital if we can't get a parent.

                Without any kind of accountability (cite & release to parents) they will be doing the same thing as soon as you leave, IMHO.

                      Juveniles unfortunately get a slap on the wrist either way in my location. However we can and frequently do take juveniles into custody for both misdemeanors and felonies. We just have to get petitions through juvenile court services from a juvenile intake officer after the fact then if they also issue a juvenile detention order they go to juvee jail. Normally though if the offense is not a serious felony we might detain them long enough to get their information then release them to their parents then attempt to get a petition. Either way, we do not issue any summons to any juvenile except for certain traffic offenses.
