    NARRATIVE: ON 07/08/07, AT APPROXIMATELY 0326 HOURS, I WAS TRAVELING
    NORTHBOUND IN THE 6100 BLOCK OF N. COLLEGE AVE. IN MY FULLY MARKED
    IMPD POLICE VEHICLE AND IN FULL UNIFORM. I HAD MY WINDOWS ROLLED
    DOWN. I HEARD A MALE VOICE CALLING FOR A PIG, HE WAS SAYING 'SUEY! PIGGY! PIGGY!' I LOOKED OVER AND OBSERVED THREE WHITE MALES AND A WHITE FEMALE WALKING SOUTHBOUND ON THE EAST SIDE OF N. COLLEGE AVE. ONE OF THE WHITE MALES WEARING BLUE JEANS AND A LIGHT COLORED BUTTONED UP SHIRT LOOKED DIRECTLY AT ME WITH RED GLASSY BLOODSHOT EYES AND SAID, 'SUEY PIGGY, PIGGY.' I WAS CONCERNED THAT THE MAN
    HAD LOST HIS PIG AND THAT IT MIGHT HAVE BEEN ROAMING AROUND IN THE
    BROAD RIPPLE AREA SO I DECIDED TO STOP AND ASSIST HIM, BECAUSE I KNOW HOW DEVASTATING A LOSS OF PET CAN BE. I IDENTIFIED THE WHITE MALE SUBJECT FROM AN INDIANA DRIVER'S LICENSE AS JAMES ADAM MCGRATH, DOB 1/22/82. WHILE I WAS SPEAKING WITH MR. MCGRATH ABOUT HIS POSSIBLE LOST PIG, I SMELLED A STRONG ODOR COMMONLY ASSOCIATED WITH ALCOHOLIC BEVERAGES ON HIS BREATH AND PERSON. HIS SPEECH WAS ALSO SLIGHTLY SLURRED. I PLACED MR. MCGRATH UNDER ARREST FOR PUBLIC INTOXICATION AND HE WAS TRANSPORTED TO THE APC BY A MARION COUNTY JAIL WAGON. I SEARCHED THE ENTIRE BROAD RIPPLE AREA AND
    UNFORTUNATELY WAS NOT ABLE TO LOCATE ANY LOST PIGS. ALL OF THE ABOVE OCCURRED IN MARION COUNTY, INDIANAPOLIS, INDIANA.

      That was funny, but, when it gets to court, it will look like an illegal stop, and free speech will be brought up. It may have been better just to state that, " On so and so at so and so, I observed the def who appeared to be publicly intoxicted. The def was unsteady on his feet, had blood shot eyes, a strong smell of an alcoholic beverage on his person, and was a danger to himself and others". If thats what happened, thats what happened. Like I said, it was very funny, and I am not tyrying to be a buzzkill, but this may bite him in court. If the guy was a drunk jerk, so be it, lock him up. He will ride in a ****y smelling wagon, get booked, lose face in front of his friends, and have to make bail. Don't ever, ever give a lawyer ammo like that in court. Stay safe, J-Bo. I really am a fun guy......I think the FTO in me just came out.

          What illegal stop? Sounds like a consentual contact to me.
          Two people can keep a secret if one of them is dead.

                I have Depo's on the 4th for a similar situation. While on a traffic stop, a car passed by and somebody yelled ".... You!". I'm not sure if it was 'hey you' or F%$# You'. I radioed ahead and had another officer stop the car to make sure that everything was alright and no emergency was taking place in that car since I felt that they may really need LE help. Long story short, found several open containers of alcohol and 4 pipes, some dug outs and a 3 foot long bong not to mention the 2 bags of weed. So goes the old saying.... There's no such thing as a bad arrest or stop. Just a bad report!

                  That's the best. I try to explain to people that they have a few minutes to mother###k me, but I have the whole shift to write my report. All facts will be true, and more than likely their words will be quoted and there for all to see. Report writing is a skill that is not stressed nearly enough in the academies and really needs to change.
                  Being a good street cop is like coming to work in a wet suit and peeing in your pants. It's a nice warm feeling, but you're the only one who knows anything has happened.

                    Whether or not the "stop" was lawful is debatable, & it might even get the case thrown out, but it sounds to me like a classic case of "You may beat the rap, but you ain't beating the ride....."

                        What illegal stop?

                        Regardless of the words exchanged or the officer's humerous report, the fact remains that the officer was on regular patrol when his attention drawn to a male subject walking down the street talking loud enough that the officer could hear every word said while driving by in in a car at 3 something in the morning.

                        The police officer stops and CONTACTS the person on the street. It does not say that the officer stopped him. During the brief contact, the officer detects signs of intoxication. As such, the officer arrests him.

                        As you can see, no one stopped this man. He drew attention to himself, the officer walked over to him, plainly viewed the signs of intoxication and placed him under arrest. However, the moment the officer approached the guy and smelled alcohol, he could have legally stopped him for reasonable suspicion of a crime.

                        In short, this person was violating a clearly established law and the arrest was based on probable cause. Regardless of the officer's personal motive, the person was lawfully arrested for a crime that he did in fact commit - public intoxication, not for what he said - thereby making the 1st amendment issue irrelevant to this case.

                          lol.. that is fantastic, well done.. As MdCop pointed out as well, this was simply a citizen contact. According to the report there was no physical force of show of authority that restrained the gentleman who may or may not have lost a pet, and by the time the officer approached he was able to develop PC to arrest the poor pet owner.

                              Just like the real ones I get from the patrol guys; if it is ALL CAPS, or third person, I won't read it. I'll find the patrolman and get it from him face-to-face before I begin an investigation.
