  • Lateral and PHS question

    Hello all,

Quick question from a California officer , if I'm looking at lateralling is it possible or is my current agency obligated to give me access to the personal history statement I gave them if I was dumb and didn't keep a copy of it? I moved a ton before I got hired and all the names of roommates, contact info and address I need are on it. It would be hard to re create. Thanks.

If you look at 1198.5 of the Labor Code, they are not required to give it to you because it was a record acquired prior to your employment. However, if you ask nicely and explain that you don't want to see your background package and just need a copy of your PHS, you can probably sweet talk some clerical in personnel into giving it to you.
Going too far is half the pleasure of not getting anywhere
