So, yes, we do put more "stock" into what the Sgt says, and writes in his official report. The news and lawyers and "suspects" can lie through their teeth, without fear of any civil or legal reprisals. The Sgt cannot. If discovered to be false, he could be fired, arrested and charged with falsifying reports. His price for lieing is much higher than people who say "The troubling things I'm reading from the lawyer aren't specifically to this incident, more lobbing allegations of past racism by the officer involved, he claims to have people willing to step forward depending on how the city chooses to deal with the incident." Which says to me... Give us money, and kiss our rear, and we'll forget the whole thing. Typical lawyer smoke screen. He can claim the world, and is hoping the city will settle on the lawsuit that I'm sure will follow, if it has not already been filed.
        You have valid points, but I'm not putting the word of any lawyer or news reporter over the Sgt. I specifically said that I believe his account is probably the most accurate. Again, I DO NOT believe that his account is exactly as it happened, it can't be. The Sgt. isn't, in fact none of us are, giong to put something like "as the suspect screamed at me, I got agitated and screamed back at him." Did the Sgt. act as professionally as he makes it appear in the report? WHO KNOWS. I choose to believe that there is a middle ground somewhere in all incidents, regardless of whether or not it's a career law enforcement officer or not.

          A. PtlCop....I don't do CNN. I watched them this afternoon and they were very, very Anti-LEO.....and were no where near what the rest of the media was reporting....including the local media that had witneses from the scene that supported the SGT and the Patrolman that responded to the scene.....so...whatever they mouth off... I don't give two craps....nor will I take what they say at face value....

          B. PtlCop....Toss me a PM and tell me where you work....so I stay clear the F away from you.....Good Freaking God.... Nothing like a left leaning Cop that doesn't stick up for a Brother when all the evidence points to the LEO being right......

            Left leaning? Not quite. I've voted Democrat one time in my entire adult life. I'm as republican as the next guy.

            Again, since it seems to take about 967 times for you to actually comprehend, I THINK THE SGT WAS PROBABLY MORE ACCURATE IN HIS ACCOUNT THAN GATES WAS IN HIS. How hard is that to understand. I'm not going to sit here and say that the Sgt. was 100% right, BECAUSE I WAS NOT THERE.

              Crap!

              I haven´t read a single post here promise, now with that said and yes learning right but open to ideas we have a one of the leftest presidents ever, more left then Carter, crap he´s spend more then all United States Presidents every until now, and waiting so please don´t put this jackass anti law enforcement Stalinist carpers as our leader, maybe because you fell too, all in Police Link feel the same and other police sites are given him the F/U !!

                Any person who was not THERE cannot attest to what actually happened. Regardless of who was at fault, my belief of the point here is the President Of The United States Of America should not be publicly taking sides on an issue such as this. This same kind of situation (irregardless of the race and/or sex of any of the participants) occurs an untold amount of times on any given day. Police officers HAVE to be cautious and thorough on EVERY CALL, possible burglary calls, even more so, if they want to go home at the end of their shift. Simple cooperation by Gates and appreciation for the job Police do everyday could have avoided the unfortunate outcome of the incident.

                  Crap I as well as others here on the job not needed to testify but have been there every frecken day responding to the same call!
                  So please don´t lay your crap story down, I´ve been shot and as others here as well responding like that Sargent in Mass. well o.k.

                      You really need to give your fellow officers more credit. Especially one who has plenty of years on, and knows all about liability, and lawyers, and lawsuits, and racial profiling claims, and all the crap that comes with not handling yourself "professionally".

                        Ok. I don't know how you author your reports, but I can highly recommend that, you never embellish reports, that you only include facts, and never place irrelevant information in them. Who knows? The other officers that were there on the incident with him.

                        The most important thing a law enforcement officer does is author accurate, reliable reports. Over my career, many of my reports were used by training officers as examples of report writing. The report serves as a historical recording document, used in courts of law, viewed by lawyers, judges, and the public. If you author reports that are "not 100% correct" I really recommend taking some classes of a "how to" type. As I posted, the Sgt can loose his job and be arrested if there are lies in his report. He also wrote that report based on the conduct of the individual at the scene. This is not at all uncommon. Place yourself into his uniform for a second, and I'm sure you would (or should) include your personal feelings at the time of the incident, as a CYA, to explain your actions to a judge or lawyer reading the report. I have authored several reports with future lawsuits and complaints in mind. This by no means indicates inaccuracies were placed in them, but rather, statements including observations of the suspect, statements the suspect made concerning racial issues, and my own personal feelings as the incident proceeded. These "feelings" and observations are important as a description of your point of view during the incident, and explain your actions to someone that is not familiar with our job. I have had a few judges comment that those inclusions helped them understand why I did certain things, as a layman they would not have understood.

                        Judges and lawyers rely on accurate police reports to make decisions every day. The best advice I can give you is, make sure your reports are 100% correct with all relevant information included in them. It will cut down on your challenges in court, and provide you with a reputation of truthfulness among your peers and judges. The way you are writing your posts, makes me think you have had experience with less than 100% truthfulness in reports?

                        I have seen my share of horrible police reports. Chock full of spelling and grammatical errors. What these officers do not realize, or care about, is that these reports are a reflection of the officer themselves. Inaccurate, sloppy reports tell others a lot about the officer who wrote them. Professionals never need to mis-speak, lie, or omit facts in reports.
                        As far as "rights" are concerned; I look at them this way... I don't tell you what church to go to, and you don't tell me what kind of firearm I can own...

                          You need to be a civilian not to know when at a scene of a possible crime to take all precautions to protect your self and the scene, the Sgt. did what we were thought from the beginning, what o.k. class #1. A possible burglary in progress, your the first car on the scene, securer i.d. secure property, protect your self and your partner, once again the officer in question did all and was chastise by the president of the united states of america!
