    Hey all.

    Got a question for you. We had an incident the other night where some kids were running around lighting bags of human waste on fire on peoples door steps. They also had airsoft guns, and almost got shot by one of our LTs when they turned around with said toy in hand.

    SO, after the whole thing, we were discussing what the best offense to go with would be. There were a lot of ideas, and none of them seemed to fit just right. Just wondering what everyone's thoughts on this would be. Don't want to influence anyones train of thought on this by posting the offenses that we discussed.

    Also, I was wondering if anyone knows a law that would deal with the human waste aspect of the situation specifically. Maybe something in the HSC? Couldn't find anything like that. Surely there is something that talks about the proper disposal of human waste.

    § 28.03. CRIMINAL MISCHIEF.

    § 22.07. TERRORISTIC[0] THREAT[0]. (a) A person commits an
    offense if he threatens to commit any offense involving violence to
    any person or property with intent to:
    (1) cause a reaction of any type to his threat[0] by an
    official or volunteer agency organized to deal with emergencies;

    (2) place any person in fear of imminent serious
    bodily injury;

    (3) prevent or interrupt the occupation or use of a
    building, room, place of assembly, place to which the public has
    access, place of employment or occupation, aircraft, automobile, or
    other form of conveyance, or other public place;
    (4) cause impairment or interruption of public
    communications, public transportation, public water, gas, or power
    supply or other public service;
    (5) place the public or a substantial group of the
    public in fear of serious bodily injury; or
    (6) influence the conduct or activities of a branch or
    agency of the federal government, the state, or a political
    subdivision of the state.
    (b) An offense under Subsection (a)(1) is a Class B
    misdemeanor.
    (c) An offense under Subsection (a)(2) is a Class B
    misdemeanor, except that the offense is a Class A misdemeanor if the
    offense:
    (1) is committed against a member of the person's
    family or household or otherwise constitutes family violence; or
    (2) is committed against a public servant.

      Like Cruz said, Crim Misch if theres "damage". You never stated if the susp(s) pointed the weapon at Lt, or just had them in hand (Poss Agg Assault on PO). DId they shoot up the houses or residents as they exited to extinguish the "hoax bomb" ??

      Depends on how aggressive your prosecutor is:

      § 28.02. ARSON[0]. (a) A person commits an offense if the
      person starts a fire, regardless of whether the fire continues
      after ignition, or causes an explosion with intent to destroy or
      damage:
      (1) any vegetation, fence, or structure on open-space
      land; or
      (2) any building, habitation, or vehicle:
      (A) knowing that it is within the limits of an
      incorporated city or town;
      (B) knowing that it is insured against damage or
      destruction;
      (C) knowing that it is subject to a mortgage or
      other security interest;
      (D) knowing that it is located on property
      belonging to another;
      (E) knowing that it has located within it
      property belonging to another; or
      (F) when the person is reckless about whether the
      burning or explosion will endanger the life of some individual or
      the safety of the property of another.

      § 46.08. HOAX BOMBS. (a) A person commits an offense if
      the person knowingly manufactures, sells, purchases, transports,
      or possesses a hoax bomb with intent to use the hoax bomb to:
      (1) make another believe that the hoax bomb is an
      explosive or incendiary device; or (2) cause alarm or reaction of any type by an official
      of a public safety agency or volunteer agency organized to deal with
      emergencies.
      (b) An offense under this section is a Class A misdemeanor.

            I don't think Terroristic Threat would fly on this one and the good thing about criminal mischief is that it doesn't have to be monetary, it just has to cause a significant inconvenience.

            Also, if any type of minor damage to the property occurs, you can always always always go with Reckless Damage and Destruction.

              This profession is not for people looking for positive reinforcement from the public. Very often it can be a thankless job and you can't desire accolades, because those are not usually forthcoming. Just do your job to the best of your ability and live with the decisions you've made.

                Is their a website that has all of these on there?? I would actually like to read through them and become familiar with them before getting into a police academy or on a sheriffs department. In the process of dropping my application for Lubbock PD and Mesquite PD right now.

                      This is the site i use http://tlo2.tlc.state.tx.us/statutes/index.htm ran by the state. Also i would look at TCLEOSE outline so you know what to read up on.

                          Thats what we ended up going with.

                          And we did at least discuss most of the other ones posted here. Just wanted to see if anyone had anything different than we came up with.
