    We are finding a ton of this junk, but nobody seems to know if it's all illegal or just the ones with the banned substances. We asked around and some officers say that they only arrest if it's a certain brand because they have tested it and it's positive for the banned substances, others say they arrest for it under penalty group 2a as a synthetic canabanoid. Just curious what everybody else is doing?! We have found some that say they comply with the Texas Law regarding K2, but they can write whatever they want on the package.

    Per state law it's a CS under schedule 2a so you could probably arrest on it, based off of your county's guidelines.

    Per my department policy we merely seize the suspected K2 and file the offense and let the Narc guys handle it from there, since we can't field test it.

      We've been getting a lot of it too. We are a two county municipality. One county takes it as a PG2 the other doesn't. I've been on a few medical calls on this stuff too. It's bad news. Unbelievable it isn't majorly illegal. Local smoke shops are selling it. We tell people we'd rather them smoke weed than K2.

        The military cannot use it. They banned it on Ft. Hood and before we deployed they were working with Bell County officials to ban it in the whole area.

          we usually do 2a, but another option is to arrest under controlled substance not in penalty group and let narc file later after they have a chance to test it. either way they go to jail and the k2 gets tested

              If you look at SB331, the law that criminalizes synthetic marijuana, there are about 100 different variations that are now illegal. But as it has already been pointed out, there is no way to field test the substance to find out if they are illegal. Here's a link to SB331 if you want to take a look at it.

                I've been running on a lot of this stuff. Mainly having to take these idiots to the hospital after smoking this crap.
