    The court of appeals ruled unanimously that Parole officers Cannot make Warrantless arrests of Parolees EVEN IF they commit parole violations IN THE OFFICERS PRESENCE???????????????

    NY once again proves how wacky it is. so now a parole officer has to say wait I see you breaking the rules but let me call a judge and get a warrant please do not run a way while I call a judge or cop so I can take you back to jail??????????? This ruling was handed down Tuesday.

          this is amazing how the court arrived at this reasoning. IS that not a parole officers job to monitor and arrest parolee's lol only in wacky nY. next they will say hey parole officers no longer need guns we will give them Tazers instead... oops better not give them any ideas. lol

            how much do you want to bet some attorney will take this ruling and the next probation officer that arrests someone the attorney will appeal saying hey if parole officers cannot arrest without a warrant then why can you? It's only a matter of time.

                they had a article in the Rochester democrat and chronicle local/state section I don't think they have a online link but it was in the 6-13-07 paper.

                  Did they arrest for the underlying charges of harrassment and OGA? Cases get dumped when the AO fails to take all the necessary steps to make a good collar.

                    parole officers are peace officers hence they can make arrests for crimes commit with in their presence and most parole violations i have to assume deal with the parolee committing a crime i mean other than violating curfew, failing a drug test, and not staying at an approved residence what else can a parolee really be violated for thats not a crime? am i to assume that this class of peace officer is being told to not make an arrest when a crime is committed with in their presence? i mean he did push a peace officer and disobeyed a lawful order to stop & attempted to leave the place of occurrence to prevent the officers from doing their job last i checked thats against the law
                    i just love how L.E.O.s get their hands tied more and more these days

                      Mark......If I remember correctly, parole violations are determined administratively. The Parole Officer must draw up charges and specifications and they must be determined to be proven before a parole tribunmal of some sort. If the parolee is already incarcerated he is just returned to prison on his original sentence. if he is on the street he is told to come in for the hearing. If he fails to show a warrant can be issued to bring him in. The officers should have arrested for the PL crimes and let the parole violations run their course. Any NYS Parole Officer jump in and correct any misinformation.
