  • The destruction of qualified immunity

Just watched Curtis Sliwa on Fox say NYPD officers now have to pay for police brutality insurance because of the repeal of qualified immunity. Is this true ?

If it worked like everything else, then yes. One would need liability insurance just like contractors. But what not yet has been said is now would those officer answer to the department or the insurance companies who hold their insurance. The department might have a rule about chasing people where your insurance might not cover it if something happens.

The premium would definitely be pretty high.

There is no requirement that you have insurance, but since qualified immunity is gone it would be a good idea. For NYPD I'll bet it would be a couple of grand a year depending on your deductible.

Anyone who takes or stays on that job is insane.

Why won't the union cover y'all?

            You're paying all those dues!

That's pretty unreasonable. No union would cover that huge cost.

Maybe they could negotiate a special rate with an insurer but they wouldn't pay the premiums.
