They base it off of the Initial Charge not its final disposition.
As you have now learned- you dont have to be physically driving to be considered dwi/dwai. So, you did it- lucky you got a good deal. Whatever you do, dont attempt to minimize your mess up. Own it, and show how you have moved on.
If you get a Proposed dq, on the psych, you should consider appealing it. Perhaps it wasnt the alcohol issue- at least get too the point in the appeal which you can review your psych file, and see what you need to work on. The you can decide from there if you wish to spend the money to put up a fight.
Yes, I did explain to the psychologist that I did learn from my lesson and etcetera but I just have to wait it out now. I practically am done with everything and I guess my BI is in progress. Haven't heard from my background investigator nor have I received the NOPD.
I appreciate your valuable feedback.

You made a statement that all Physicians / psychiatrists are are MD's. And all psychologists hqve Phd.'s. It was a over broad, and patently false statement. Just because your statement was wrong, no need to get like a child.Problems with a psych exam?
Have an upcoming PSYCHOLOGICAL EXAM that you NEED to PREPARE for?
If your Disqualified, Pressured too withdraw, Recieved a Proposed DQ or want to talk about the appeal process- check these guys out. Doesnt hurt too call them- free, detailed telepone consultation before
you make up your mind.

When asked about alcohol... It went sonething like this...
do you drink? (Yes)
how often? (sporadically)
how many till you get drunk? (Probably not many, i dont drink to get drunk)
Why do you drink? (Well, nice dry red tastes awesome with a steak. And nothing like a beer with hotwings).
That ended her questioning about alcohol.
as far as the alcohol specialist- i believe he is a supervisor at psych services. I've read appeal cases where he did second interviews.
as far as the statistics- ive searched high and low and could never find anything concrete.Last edited by Vista; 06-24-2015, 12:41 PM.Problems with a psych exam?

I feel unsure about that. The Doctor had me working and searching high and low for the record, just to get it and then nix me off the list. And no I never had any negative actions while in the Military. I did however land in some hot water while off post once, that jammed me up somewhat, but I had it taken care of quicker than a squeaky wheel. The Army understood it and took my side, hell even got promoted like 3 months later. The Doc seemed in disbelief that it turned out as such which is how I ended up on review =/
