NYPD Psych DQ or on NYPD psych review info and help..

  • The attorney I'm using for my appeal. I know people who took tests in 2009 who are still appealing. They expire by the end of this year.

        Don't be reluctant to apply for other agencies, Jay. NYPD isn't the only game in town.

            But the list they were on has long expired from 2009. To re-establish eligibility: they would need to re-test; APD would then re-open their previous file and disqualify them on that basis of previous disqualification determination. Being re-instated to the list by the Civil Service Commission is by no means a guarantee to being appointed. Due to zone scoring, NYPD and other police agencies in New York State have broad discretion in making appointments.

                  You may be suprised to know that NYPD, actually bases their evaluations on the original charge as opposed too final disposition of an offense.

                  Unfortunately, many NYPD Psychological disqualifications are disqualifications that should have been character dq's, if even a disqualification at all. NYC CSC is aware of this and has even chided the NYPD over this.

                      As well as other NYPD Exams. I know someone who was psyched out once, appealed and lost. He took another nypd exam, took another psych (with a different nypd psychologist) who actually weighed his Appeal Psychologists report heavily in his decision, and passed him.

                        Character disqualifications are next to impossible to contest as New York courts has consistently ruled in favor of the appointing authority's judgement in determining fitness to positions of a sensitive nature. The only legal bar to appointment is a felony conviction.

                        Psych evaluations are "hit or miss". Just an art and NOT an exact science. And "hiring and retention standards" vary from agency to agency. For example, a 'terminated for cause' former law enforcement officer would never be considered for a police or corrections position with New York State or NYC and would be "disqualified". Yet, another agency upstate would consider their overall employment record and give them a second chance given their training and experience.

                        Another hiring issue that bar many from LEO appointment was the "wrongful death" theory. Meaning if the applicant with a controversial background who gets hired were to cause a wrongful death the appointing officer, himself, would be held PERSONALLY liable fro his employees' actions. The U.S. Supreme Court rectified this back in the mid-1990's absolving personal liability from the appointing officer.

                        Generally speaking, to get hired in upstate New York to a police position its "who you know". Vacancies are quite scarce and applicants are many. The payscale is lousy. The local community colleges churn out MPTC certified candidates (Phase 1) at their "police academies" costing $3,000 per student. The problem is the pre-certification is only good for two years. So unless they get hired into a police position in that time frame--their certification will expire and they must ,again, repeat the BPOTC.

                          That's a rarity, for one NYPD psychologist to contradict another NYPD psychologist's opinion on the record. But did he actually get hired??

                              If you're the candidate who was previously psych disqualified, lost your appeal with CSC, then re-tested with NYPD...you still face a rocky road ahead of you in getting hired by NYPD even if the psych unit passed you the second time. NYPD has a broad latitude in making appointments off a certified list of eligibles.
