LEO visiting NY City...

  • LEO visiting NY City...

    I'm going to be visiting NY next week and I thought I'd check with my NYPD bros about a few things...

    I'll be carrying my off-duty gun under LEOSA, but is there anything I should be aware of? The only threads I could find on the topic were a couple years old.

    I'll be going to a show at Gershwin Theater with my wife on Tuesday evening; anything we should know? Best routes, places to visit, areas to avoid?

    i believe any license to carry is suspended in new york city unless it is registered with the nypd (meaning you would have to go to one police plaza and fill out paper work). This is what got plaxico burress jammed up, he had a license to carry or a permit or something but wasn't registered in NYC.

      He said he was carrying under LEOSA. He is fine to carry in NY and anywhere else in the US.

        yeah i thought all the laws were suspended in big cities, but i googled it and it looks like as long as you meet the criteria you're ok to carry.

        doesn't mean you won't spend a night in jail and have the judge sort it out in the morning though

          I don't know any MOS here that would collar another LEO for concealed carry under LEOSA.

            HR 218 will not be a defense to possessing hollow point bullets, carrying a weapon on a school campus, carrying a prohibited weapons, carrying a weapon in a casino, etc. Some of these scenarios are illegal in certain states. Know HR 218, but also know the laws of that state in which you intend to carry!

              Wow and this is why non LEOs need not respond to serious questions on here! So you really thouhght that all laws were suspended...? Wow.

                ahhh...

                Enough!

                You will be just fine carrying here if you are a legit law enforcement officer with a right to carry a firearm. Make sure you have your credentials with you at all times.

                      He doesn't (and neither am I, but this thread gets posted every couple of months or so). There have been multiple threads here this past year I have seen. According to them all if you carry all the proper credentials as said above you're golden.

                            Heah Optionsopen, You are a Student, correct ???..... Stop postulizing about carry permits, NYC, LEOSA, and stuff you obviously know NOTHING ABOUT.

                            Civillians get permits to carry a gun. All New York STATE Pistol Permits, have a big stamp that says "NOT VALID IN the City of New York". To get a permit valid in NYC, you need to get an endorsement from NYPD, which Palxico Burress DID NOT HAVE.

                            Almost all other LEO's in NYS, get their authority from the NYS Criminal Proceudre Law. In this law, i is written, you are either a "Police Officer, or a Peace Officer".... It is also written whether or not you need a carry permit. If NYSCPL says you're a cop, and does not say " may not carry a firearm unless a permit is issued under section 400 of the NYS Penal law. You can carry.

                            As far as LEOSA, because it is a Federal Law, that trumps NYS law, or NYC law, and you will be ok to carry.

                            Heck I rmember 20 years ago, WAY BEFORE a LEOSA, when a N.J. Officer was robbed in NYC, and he drew his firearm to defend himself against knife wielding thugs in the subway, He was not arrested or prosecuted, but the thugs were.

                            No cop that I know of will arrest someone who is lawfully carrying under the LEOSA.

                              Just remember, under the LEOSA, you are carrying as a civilian and any use of force will be judged as such. Again, I am pretty sure you will ONLY use DPF to protect you, your family or a third person's life, so that is pretty much the same throughout the country.

                              As a civilian in NY, you are NOT allowed to carry a "large capacity ammo feeding device", meaning more than 10 rounds. While I am sure any LEO will not bust your balls, just know that law does exist.

                              There was an incident in NYC, where NYPD arrested a PA constable for CPW, I believe charges were dropped and weapon returned after sometime. Not sure the details of the case... and I believe that to be an isolated incident.

                              Have fun in the city, some theatres and stadiums to search you but either they will escort you through the press entrance once you ID yourself, or you will lock your weapon up at the local precinct or substation on location.
