  • Conspiracy Question

    If you charge one person with conspiracy, are you required by law to also charge the other? Lets say you charge a guy with a 1st degree crime and he says he conspired with somone, putting him in violation of 2nd degree conspiracy.

    If he gives information to lead to the others arrest and works out a deal, is it possible to downgrade him to a lesser charge, say the same crime at 3rd degree + 3rd degree conspiracy and still get the other guy with the 1st degree crime + 2nd degree conspiracy?

    I say charge them both with it and the cooperating guy's charge will get downgraded or dismissed later by prosecutor's office. The other guy's charges will probably get downgraded or dismissed by the same prosecuor's office too, but that's another story.
