Do you have to have a foid card in Illinois if you are a sworn officer

  • #2
For personally owned or department owned firearms?
Getting shot hurts! Don't under estimate the power of live ammo. A .22LR can kill you! I personally feel that it's best to avoid being shot by any caliber. Your vest may stop the bullet, but you'll still get a nice bruise or other injury to remember the experience.

I don't think it matters if it's for personal or department weapons, you'll need a foid either way. They even want a copy of it during the hiring process.

Technically no. Most departments require it though.

^ Uhhh, yes. You need a FOID. Departments will require it, will ask for it and will routinely check to make sure it is valid. If a copper ever becomes involved in a domestic situation, that FOID could become revoked and copper loses his job per state law because he can’t own a weapon. Same thing goes for OOP’s that require said person to relinquish weapons. No weapons, no job.

Don’t get a foid card confused with a consealed carry card. Everyone needs a foid card however sworn officers do not need a consealed carry card. The only exception to the foid card rule is living out of state but being a sworn IL officer. For example When I started my job I was an Indiana resident I was not required to have a foid card.

Exactly what I was referring to.

Indiana residents need to have a foid card as well.

There was a thing about this, maybe 15 years ago on Chicago, where guys would let their FOID lapse, quoting this part of the statute. While technically correct, it would mean you couldn't carry your gun back and forth to work, and would have to check out a gun at work, then return it at the end of shift, all impractical. You would not be able to carry off duty. The city then came out with the order that you must have, and keep valid, an FOID card.

And, when the domestic violence laws came into being, maybe 20 yrs or so ago, a Burbank P/O was arrested for a domestic. His FOID got pulled. The Dept. put him on a leave. He sued to be able to work, quoting the above exception to the law. His lawyer said that he could leave his gun at work, be issued it while on duty, then return it. Burbank had no obligation to do this, refused, and he was terminated.
