    Judge sentences ex-deputy for lying

    Officer jailed for covering up cruiser's damage

    The judge told former Broward Sheriff's Deputy Lewis Perry that cops don't lie. But Perry did, actions deemed by the judge as "unacceptable and unforgivable" because they erode public trust in law enforcement.

    And with that, Perry was sentenced to nine months in jail to be followed by five years probation for lying about causing an accident and then concocting a hit-and-run story to cover up how he damaged his patrol car.


    "You, Mr. Perry, must be an example that if you besmirch your badge and show a disdain for your oath, a severe consequence will result," said acting Broward Circuit Judge Joel Lazarus.

    Perry was taken into custody immediately.

    A jury convicted Perry, 40, in April, on three felony counts of official misconduct, one count of perjury and one misdemeanor count of falsifying records.

    Perry told supervisors and investigators his cruiser was rear-ended Nov. 12, 2003, while he was stopped at a traffic signal. Instead, they later learned, Perry chased and cut off a fleeing, stolen SUV after a sergeant had called off the pursuit.

    Perry faced up to five years in prison on each felony, but because he had no criminal convictions, the judge could have sentenced him to probation only.

    Perry's defense attorney, Eric Schwartzreich, felt Perry's sentence was much too stiff.

    "I don't think Lew Perry's a criminal," he said. "And I don't think the streets are safer by putting Lew Perry in jail."

    Perry's tenure with the Sheriff's Office was a rocky one. Since joining the agency in March 2001, he was the subject of 11 internal affairs investigations and was fired twice.

    The Sheriff's Office most recently fired Perry in February, the same month that the agency settled a federal civil-rights lawsuit with a Mexican laborer whom Perry mistook for a burglary suspect and shot in the head. The case was settled the day before the $15 million federal lawsuit was to be heard in court. Details of that settlement have been sealed.

    Because of the felony convictions, Perry will lose his state certification to be a law enforcement officer.

    Before the trial, prosecutor David Schulson offered to drop the charges if Perry would give up his state certification. Perry, instead, opted to go to trial.

    "It's because of what he did that people question the integrity of honest hardworking cops out there," said Elliot Cohen, spokesman for the Broward Sheriff's Office. "It tarnishes the image and erodes the trust that people have in law enforcement."

    Wow what a moron, with his history and the fact that he knows he is guilty and they offer him a chance to get off with no charges if gives up his cert and he refuses and now has a felony conviction and loses his cert and goes to prison for 9 months.

        I booked this guy last week after they brought him down from the court room. He is more than likely going to be in Protective Custody in the Main Jail. The only toilet he will clean will be his and mabey a He-She or 2(Just Kidding about the he-she).

            Dag, take the plea. You know you're lying. You were caught lying, you were indicted for lying, you faced jail time for lying, you've been fired twice. And all they wanted was your CERTIFICATION??? take the freakin plea. What a clown.
