      Just because there's a statute for something doesn't mean you should arrest for it. Florida also still has a law that prohibits unmarried people from having sex and living together, (798.02) however you'd be stupid to arrest someone for it. AELE put out a bulletin some time ago that dealt with officers arresting people and seizing their recordings when citizens recorded police activity. Not only did the arrests get thrown out, but the officers were found to be PERSONALLY liable in federal court for civil rights violations. As public officials, citizens have the right to record our actions as long as there's no expectation of privacy (like a phone conversation). It doesn't matter what the Florida Statutes say. There is plenty of case law that supports this.
