Violation of a city or county ordiance is a second degree misdemeanor (statewide). You'll usually find that the max punishment for these offenses is a $500 fine and/or 60 days in the county jail in the ordiance.

    Need Assistance

Hi everyone, i'm applying at different agencies and i'm filling out a State applicaton and i need assistance on the background information because I'm confuse and I want to DISCLOSE everything to them. These are the questions:

(1). HAVE YOU EVER BEEN CONVICTED OF A FELONY OR "FIRST DEGREE MISDEMEANOR"?
(2). HAVE YOU PLEADED NOLE CONTENDERE OR PLED GUILTY TO A CRIME WHICH IS A FELONY OR A "FIRST DEGREE MISDEMEANOR"?
(3). HAVE YOU EVER HAD ADJUDICATION OF GUILT WITHHELD FOR A CRIME WHICH IS A FELONY OR "FIRST DEGREE MISDEMEANOR"?

situation: I was charge with a county ordiance (misdemeanor) violation back 1998 and i had WH ADJ W/FINE & Court Cost- BUSINESS W/O LIC (Nolle Pros).

My question is: Is this a first or second degree misdemeanor? I checked everywhere in the internet including Miami Dade Ordiance violation handbook and I was not able to find the answer. My opinion is that this ordiance violation is a second degree misdemeanor, I may be wrong, and I was not convicted of it... i just had to pay a fine and court fees. I believe the answer is NO to all three question.... what would you guys do? I ask because I don't want to make any mistakes on the apps that would immediately DQ me... what would you guys do? Any advice will be gladly accepted.
    Thank you
