    Looking for Colorado law regarding the ability of an employer to exclude an applicant who is CURRENTLY able to perform the physical requirements of a position, based on their concern that the applicant may be unable to perform at some point in the future.

    Specifically, the physician performing the medical exam for a potential employer disqualified me due to my spine fusion on the grounds that I may re-injure my back at some point in the future... even tho I am presently able to perform the physical demands and complete the testing for the job, and there is no specific disqualification for having had a spine fusion.
