    One dead, two at large after Trinidad robbery

    Authorities across the state are searching for two men who they say were involved in an early morning robbery that left one of their crew dead with a gun-shot wound to the head.

    Police say the homeowner shot through his bedroom door at the robbers who broke through their front door. Rory David Rodriguez, 24, from Denver was shot in the back of the head, then later died at a Pueblo hospital. Trinidad Police Department has issued a warrant for two suspects.

    Alejandro Antonio Rodriguez DOB 08-06-90 last known address 401 S. Spruce in Trinidad Co. 81082.

    Mario Dean Chavez DOB 04-19-90 last known address 3260 W. 14th Ave., Apt #344 in Denver, CO 80204.

    Both suspects will be charged with first degree burglary, a class 2 felony; first degree trespassing, a class 5 felony; conspiracy, a class 6 felony; menacing, a class 3 misdemeanor; and attempted theft, a class 2 misdemeanor.

    In California they would have been charged with the murder of their accomplice. California has a law that if someone dies while commiting a felony, the criminal gets charged with the death as a murder. But then again in California the home owner would have had to get the gun out of a safe, take the trigger lock off, load it, then shoot, giving the criminal more time to commit the felony.

      We also have felony murder in Colorado.

        I thought felony murder rule in CO wouldn't cover the accomplice; thought it had to be someone not inolved in the commission? I could be wrong.

          If you take part in the crime and your partner kills someone or your partner gets kill you get charged. Even if you were just the driver. I was glad to see it come to Colorado as well as the Castle Doctrine.
          The early bird may get the worm, but the second mouse gets the cheese.
