22350 for make-up, reading, shaving etc

    22350. No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.

    I've seen people driving while shaving, applying make up and even reading the newspaper none of which is safe. That being said, their safe speed would be 0 MPH. Can you cite them for 22350? Has anyone ever done it?

    No. Shaving, makeup and any other distractions have nothing to do with driving at a safe speed. There is no law against doing these things.

      Actually you can, IF you can prove what they were doing was causing an unsafe condition.

          CVC 22350 has nothing to do with creating an unsafe condition; it covers driving at an unsafe speed for conditions. Not conditions you are creating within your vehicle, but the conditions of everything around you, i.e. traffic, weather etc.. By your logic, talking on your cell phone could fall under CVC 22350 because you are creating an unsafe condition within your vehicle. If so, why did the state spend so much money on specific legislation prohibiting cell phone usage while driving?

            I've seen a couple motor cop's do this successfully in court. They make it very clear that there is no safe speed to do this and are traffic experts...not something for the inexerienced.

                I deleted my post, I don't need to defend myself on how many citations I have written. All that matters is I have written them and have never lost in court.

                    I've used 22350 quite a few times for conditions they create themselves. 1st was during the click it or ticket campaign. The lady dropped some papers on the driver's side floor board, unbuckled her seatbelt and bent over to pick up the papers. She was making a left turn at a major intersection at the time, doing about 20 mph. I cited the 27315 and the 22350. It flew like a rocket.

                    2nd was a soccer mom dropping her kid off at school. she had the side van door open in the middle of the street. The kid was half way out when mom saw me coming. She pulled forward at about 5 mph. I cited 22350 and it flew too.

                    Both went to court and got convicted. It really depends on the judge.

                      Me too. I actually wrote a lady driving with a big dog on her lap. The dog was clearing blocking her view of the road and her ability to steer the vehicle. It never went to court but I was expecting it too. I would have been ready and I feel confident I would have won it.

                        I see this ALL the time. Assuming there is no specific law for this, are any other LE's citing these people for 22350??
