  • CCW question

I,m probably gonna get my balls busted for this one, but alas, I have no shame....

I read this question in "Ask a cop"....

Here it is.... When your pack'in heat with a valid CCW permit, Is it still legal to pack if you have had One drink...... Or is there a BAC level to "break through"....

Of course, this Question is for pubic places only....

And in closing... I'm gett'in old, i cannot fer tha' life of me even reviewing this aspect during my last mandated 4 hour sit down.

I'll be in tha' area all day.....

If you are involved in a shooting and you've have any alcohol in your body, you would face MUCH scrutiny.

Pre LEO, I carried concealed for 10 years, and I had to present my firearm once in that time. Police on scene supported my judgement.

Hypothetically, If I had a beer at Applebees, I wouldn't carry my firearm while in the restaurant. If I stopped on the way home to use an ATM, I'd grab my firearm. If I were accosted at the ATM, I'd do what I needed to defend myself. Survive now, everything else is gravy. That's my choice, but I wouldn't tell anyone else to operate that way.

    Alcohol affects judgement, period.

Maybe I'm a shut-in, but I really only feel secure drinking at home.

There is not statutory "magic number" as it relates to BAC and CCW. While it may come under scrutiny when patrol is called to the scene, they'll evaluate everything involved, not just whether you have any odors of congeners coming from your breath.

While it's highly recommended that people don't carry if they're gonna be drinking, there's nothing expressly prohibiting it. If the government were to do that, it would make them 100% responsible for your safety and well-being while intoxicated.

That'd be a whole gaggle o' peeps we'd have to babysit.

Got it.... Yes, the scrutiny meter would jump up after a shot or two of red-eye.

Or save the money and look online as statutes change from year to year.

I don't carry if I'm out and drinking just because of the fact that if I end up needing to use my firearm, the potential criminal and/or civil prosecution would LOVE to have that nugget on their table. Even if it's just one drink, lawyers will use it and crucify you every chance they get.
Personally, I have a near 100% flawless method to make sure that I never run into this problem; I don't drink unless I'm at my home, a friends, or a family members. :-)
