RE: LEO Provisions in FY 2008 Omnibus Spending Bill

SUMMARY: The House and Senate have negotiated an omnibus spending bill that includes LEO provisions for CBPOs. Prospects for passage and the President’s signature are still uncertain.


The omnibus spending bill to be acted on this week in the House and Senate includes a new Section 535 that provides a modified Law Enforcement Officer (LEO) retirement benefit to all Customs and Border Protection Officers (CBPOs) prospectively beginning July 2008. If enacted, Section 535 will grant a retirement enhancement for those current CBPOs who will not be able to serve 20 years under the standard LEO system and be at an age to retire early.

If enacted, Section 535 ensures that:

• Premium and overtime pay coverage is not affected. Half of yearly overtime pay will continue to be included in calculating the CBPO’s high-three salary.

• All current CBPOs who elect the new coverage will find their contribution to retirement increased by .5% and will receive a more generous LEO pension from July 2008 forward.

• Mandatory LEO retirement age of 57 years would be waived for all current CBPOs. All CBPOs hired after July 2008 would be subject to mandatory retirement at 57 years.

• The current Federal Employees Retirement System’s and Civil Service Retirement System’s age and service requirements would apply for those who meet those requirements before serving 20 years post July 2008. CBPOs will be eligible to retire after 20 years of post-July 2008 service at age 50 or 25 years of post-July 2008 service at any age.

The omnibus spending bill provides funding for the hiring of an additional 400 CBPOs in FY 2008. This past year, CBP developed a Workload Staffing Model (WSM) to generate estimates of staffing needed at the ports of entry to meet workload and mission requirements. CBP is directed to brief the Committees on Appropriations not later than January 31, 2008, on how it is using “the WSM to improve staffing resources to reduce airport and land port wait times, and to enhance performance in meeting customs revenue collection responsibilities.”

The omnibus spending bill also includes funding for the Office of Chief Human Capital Officer, but “[N]o funding is provided for MaxHR or any follow-on personnel system. Instead, $10,000,000 is provided to address the Department’s dismal results in the 2006 Federal Human Capital Survey.”

Also, as part of the omnibus spending bill, the Transportation Security Administration (TSA) is directed to submit a report to Congress on the implementation of the Performance Accountability and Standards System (PASS). The report must include: the number of employees who achieved each level of performance; a comparison between managers and nonmanagers relating to performance and pay increases; the type and amount of all pay increases that have taken effect for each level of performance; and, the attrition rate of employees covered by PASS. The bill also directs TSA to start a pilot program at seven airports which will require the screening of all airport employees for a 90-day trial period, after which the program will be assessed.

LOL @ NOPD!!! Here in DC several of us have been avoiding being promoted and changing our series due to very good chance of this happening. NTEU posted that the bill has passed both House and Senate and is awaiting the President's signature. As far as everyone concerned this is going to be a reality. A hybrid calculation for us old timersand everyone else (Officers joined after July 08) will fall in line with normal LEO retirement system. We all will still be paid overtime (Copra) and not fall under AUO. Which I think is a better deal. See my earlier post for (Proposed) retirement calculations.
It's looking very good!!! CBP need this to keep people around.

If anyone find addtional information please post. I will update as information comes in. I am sure there will be changes and modification as time goes on.

Hey guys!!!

Hopefully I can get in before the change takes effect in July 2008. My hubby was talking to me about all this last night after he got home and was talking about how every grandfathered in before July 2008 will still be paid at the double time rate. Man how wonderful is that! Anywho...I go for my VBT next week; and hopefully I can get my academy date before the BIG July!

Absolutely zero. a 70 is as good as a hundred. if you carry a 95 average for all eight tests you get a certificate. Big deal, it aint worth studying all the time, use your free time to have fun so you dont go stir crazy. and NOPD, good call on the booze, stock up on saturdays!!

Well I just started my first week at my port as Pre-FLETC. I've been given a LOT of information about FLETC and other things. I'd just like to clear up this information that I've been given:

Sure, a 70 is as good as 100 on tests if all you want to do is just pass. There are several awards available to FLETC trainees for firearms, PT, etc. A 95 avg does in fact give you a certificate, and being the top of your class gets you an even bigger honor. If you plan to get into special groups within CBP (and there are a lot!), you'll have to compete with others. If you plan to join other agencies, like the FBI or ICE, they also look at this. If you're okay with just doing passport control, then by all means, enjoy yourself.

I see it all the time at my port, if you've got a family, then by all means, stick with something stable. However, I myself hope to get into lots of different things.

Good luck to all you still in the hiring process! I hear some of you are about to do your VBTs.. while I don't want to give too much info that'll jeopardize the whole point of testing, the best advice I'd like to give is that they like to see that you can think on your feet.

BI before test

Actually I did both at the same time. When me and the hubby were in Ohio, I applied for a tech position at the Cincinnati airport because at the time they were hiring three techs (in June 2006). So for that position I went through a full BI when I was supposed to actually go through a mini BI (I was told that I would do a mini BI but as it turned out it took 6 months to clear and I found out they did the entire BI). Around the same time, an announcement came out for CBPO's and I was scheduled for testing and took the test. So because of two different announcements and their timing, that is how I took the test about the same time as when my BI started. Unfortunately, the funding halted on tech position after they hired one tech because of the funding that was needed for the BP positions (when I called Minneapolis and asked why it was taking so long for me to get a call for the tech position, the person I spoke with said that hiring had been put aside for now because of the BP hiring spree). Well, I got tired of waiting and the hubby wanted to get back down to the border, so we figured this would be a good opportunity for the both of us because the announcement for hiring CBPO's in the southwestern border came out and I put in for it. I guess I can't really say that it was unfortunate because here I am hopefully going to be a CBPO in the near future!

Hello Sterism!

Thanks for the heads up!!! From what my hubby said, trying for all the certificates and high honors should be a strong desire for anyone going into FLETC. Besides the "feel good" feeling that you receive, it will help you in your future endeavors when you are competing against others and you happen to have that extra tidbit on your 612. Besides that, he mentioned that some ports (do not know exactly who) but some ports will even reward their future officers if they come back with honors i.e. time off.

I have to go in with the desire to get honors just because of my hubby. He didn't graduate with honors but I have to be better than him and he did graduate with expert on the firearms and if I do not get expert on the firearms, I will not live it down (I was a Combat Arms Instructor in the Air Force).

I will try and do what I can while at FLETC!
