        • And I don't mean you're gonna fail your background, I just mean that they can't complete your background until any and all cases in court are closed.

                      I know first hand about this situation. The form does ask the 7 year time frame, but during my poly, I was asked have I EVER? I received a NOPA, replied, I just recently accepted a position for Buffalo, NY. EOD July 21st, Academy start August 18th - December 30th.

                      So just be honest, they do ask TWO different questions and I think they need to revise the form to say have you EVER, this way it will eliminate a need for a NOPA later on after the poly.

                        I agree, but I'm not sure that will even bypass the NOPA process. For example, I had fully disclosed on the form resigning from a job 7 years ago (and stayed consistent when questioned by the poly examiner), yet that was still listed in the NOPA as something I had to respond to.

                        But glad to hear you got through it, that is encouraging to me. Can I ask how long it took once you sent your response back? And did you bother consulting with a lawyer or obtaining an affidavit/other documentation? Thanks.

                          You got a NOPA because you resigned from a job? I resigned from a few jobs because of better offers/partnerships. However, these were all on very good terms. Would that still warrant a NOPA?

                            From what I recall, I received the NOPA mid February 2014, replied on February 20th, sent a fax and a letter in the mail just to make sure they received it. I did not consult a lawyer, I just provided the facts and tried to keep it simple. I was then scheduled for my VBT shortly after that.

                            Timeline below:
                            Written Exam Scored 91 – August 19th, 2013
                            NOR – September 13th, 2013
                            Border Patrol Polygraph – September 3rd, 2013
                            TSL – December 16th, 2013
                            Medical – December 31st, 2013
                            NOPA Received – Mid February 2014
                            VBT/SI – March 10th, 2014
                            Meeting with Background Investigator – March 27th, 2014
                            Received follow up for more clarification from original NOPA – June 25th, 2014
                            Background Cleared – July 1st, 2014
                            Drug Test Conducted – July 2nd, 2014
                            Got the call!! - July 3rd, 2014 – Accepted Buffalo, NY
                            PFT2 – Unknown yet – waiting for email confirmation.
                            EOD – July 21st.
                            Academy Start – August 18th.

                                Not quite. It was a job where I was still in the training process, when it turned out that it wasn't the right job for me (let's say). I showed up every day, got along with people fine, didn't steal or do drugs LOL; just wasn't wired for the job. I was not meeting the "standard" they were looking for, and they hinted that at that point it was unlikely I would succeed. I said I understood and that it was time to go with another career path. I believe I left on good terms, but to be on the safe side I indicated that I left the job by "Mutual Agreement" due to "unsatisfactory performance".

                                So unless you said yes to being fired, or leaving by mutual agreement, or anything else unfavorable; you should be fine I would think.
