Well that is the extent of the "derogatory material" noted in the letter that I must respond to. So, I guess I don't know the entire situation either.

I hear this is a pretty standard process. The only other thing I can think of is that I admitted to the drug use during the poly, but I didn't note it in the SF-86 (didn't have to as it was over 10 years ago). The resigning from the job part, I fully disclosed originally. So who knows.

    • I am in the same issue as everyone else with the medical. The doctor's office that did my testing forgot to do my eye exam without my contacts in. I asked about it and they said no it will be fine. 3 weeks later I got a call to go back to do the eye exam without my contacts. I did that a month ago. Still waiting on the green light.

Same thing with me, except I was asked to provide a prescription from my eye doctor. I wasn't given the option of going back to the clinic.

Wait, what? Then why bother having "In the past 10 years" on SF-86 if you still have to say you've done an illegal drug throughout your life; past the 10 year mark?

Are all SF-86s the same? I did one for the USSS a few years ago, but I don't remember that question. I still have it saved on my PC somewhere.

Are you sure there wasn't a question pertaining to doing any illegal drugs throughout your life?

The generic SF86 PDF I have asks the question twice in two different ways. One which asks "in the past 10 years", and one which asks "have you ever".

            • Looking at the hard copy of the SF-86 I submitted, and it only asks about the last "7" years (remember it being 10). Nowhere does it ask "have you EVER" regarding drug use, only if you have seeked or been ordered to treatment (or used with a current clearance or while serving as a LEO).

Well, good luck Fdriver. I could be way off base, but I have a feeling this isn't that a big deal, and you'll move on.

Thanks. I am keeping my fingers crossed.

And yes, the SF-86 seems to change a little every few years or so (or perhaps different agencies use different versions). The one that carried over onto the eqip this time around (was done a few years ago for another job), some answers had to be changed.

Out of curiosity, is there anyone out there who has NOT received a NOPA for issues like mine ie. isolated instances of marijuana use?

It seems they are somewhat different depending on agency. I think you'll be just fine. Minor MJ experimentation is not the end of the world for CBP. However, from what I understand, any MJ use ever will disqual applicants from other Fed agencies.

What I don't understand is why the examiner went outside of the parameters of the SF86. If the forms asked 7 years, why would the examiner dig for a lifetime? Seems a little strange to me as they could just amend the SF86 to reflect this from the beginning.

Nah, I don't know about that. When I had my poly with the USSS, they didn't seem to care, only that you tell the truth with what you've done and how many times. Now if you were a habitual user within the past few years or whatever, then yeah, I can see it being a problem.

From what I have heard and read on forums like these, FBI maintains a zero tolerance policy for any lifetime MJ use. I could have been misinformed but that is the Fed agency I was referring to. I experimented with MJ twice back in 1998 and if it comes up on the Poly I will be upfront about it. Guess I should get my NOPA response(s) ready now.

In the poly, they are looking into much more than just what was within the parameters of the SF-86.

When you actually meet with the BI (I have yet to do), I believe it is strictly SF-86.

                              • The SF86 asks a question like, 'Have you been arrested detained questioned by police in the past 7 years?' I believe the drug question is somewhat similar. They may ask you similar questions but they wont say "in the past 7 years" they will say "Ever" Trust me, if they say ever, they mean EVER.

It will catch you off guard cause you figure if it's not on the SF86 then you don't have to talk about it, but you do.

I used MJ freshman year in highschool (97) and I was arrested as a teenager. I had to tell them all that fun stuff, but...I passed and that is not an issue with my adjudicator.

(if anyone is wondering, i'm on hold right now because I have traffic court on August 8th, and you can't pass backgrounds if you have any open court cases.)

                                Hope this info helps.
