  • Heres a real good situation that has not been presented before.

    A friend of mine is on my same timeline - He met with his BI last September. Everything else had cleared up to that point, he was just waiting for the BI to clear. Real good kid, never got in any trouble, clean as a whistle.

    That January, he is arrested on bogus charges, one for disorderly conduct, the other "resisting w/o violence". I dont even know what that is. I was there, saw the whole thing. Leave it to Miami PD to falsify arrest reports. I really felt for him cause all he did was ask a question and they took him in.

    His case was diverted to some program in FL where if you complete the requirements the case is judged nolo pros and then sealed and expunged.

    During this whole ordeal, his Background Cleared and has been cleared ever since. I am assuming it cleared because this nonsense happened after he met with his BI so there was nothing to disclose.

    SO - his case is now on its way to being closed, sealed, and expunged. The charges were as ridiculous as the arrest report that went with them (which stated he was waving his hands and would not stop shouting..no joke he went in for that while in reality he didnt even raise his voice)

    What does he do? The background cleared. They wont run another check for years, correct? I believe its every 4 years? Our secret service friend said dont ask dont tell policy is probably the best for such a useless situation.

    I would really like some feedback from Merlin and any other CBPO that knows what could happen. I would rather not play the "you gotta tell the truth or itll bite you in the ***" game with CBP hopefuls, because you know what, this is a clear cut case of bad police overstepping their bounds and using power corruptly, so why should he put his future at risk for something one bloated officer decided to fabricate. - all comments are welcome of course, if you have insight to this situation.       I would go with the Don't ask don't tell. BI already cleared hes good unitl next review, by that time it will be off his record . Used to do security clearnces for the Army

        Here's the definition of Nolle Prosequi (Nol Pros):

        nolle prosequi

        "Latin for "we shall no longer prosecute." At trial, this is an entry made on the record by a prosecutor in a criminal case stating that he will no longer pursue the matter. An entry of nolle prosequi may be made at any time after charges are brought and before a verdict is returned or a plea entered. Essentially, it is an admission on the part of the prosecution that some aspect of its case against the defendant has fallen apart. Most of the time, prosecutors need a judge’s permission to “nol-pros” a case. (See Federal Rule of Criminal Procedure 48a.) Abbreviated “nol. pros.” or “nol-pros.” "

        In essence it means that he was not convicted of the offense charged. In an abundance of caution you could bring it to their attention and provide all of the evidence in support of it being withdrawn by the prosecutor. If you don't address it now though it will likely re-appear in the future to haunt him. (i.e. they may be concerned as to why you didn't inform them of the offense). I would imagine you have a duty to notify CBP if anything happens that might otherwise affect your eligibility for the position. But until anyone can confirm the rules regarding same, just take it as my personal opinion.

          I would disclose it.

          The first on the job incident he gets involved in where he has to testify in court (and it happens) could mean his background and personel file MAY be subject to subpoena by the defense (subpoena duces tecum?). If the past arrest comes out (usually a record of expungment exists) and it becomes known to his superiors that he didn't voluntarily disclose it when it happened, could mean a case being tossed, then possible termination from employment.

              • Just got back from taking the new fitness test. Here are some of my observations:

                Relatively easy test.

                The foam block makes doing the pushups a breeze. Got into a good rhythm of bouncing off the block, I usually do my pushups to the floor, so this almost felt like cheating.

                I was able to get 14 touches in the side to side test. Going into the test, I wasn't sure how many I could get in 10 seconds. I was happy with 14.

                Lift test was good. Remember to keep your head up, makes lifting easier on your back. Knocked it out in 24 seconds.

                Situps were straight forward. Just smack your elbows on your knees. My tester was real cool, she kept egging me on to get one more.

                Step test is still the step test. Up Up, Down Down, Up Up, Down Down....

                Glad the hold the gun out and pretend portion of the test is gone. Always made me feel like an idiot.

                All in all, the new test is nothing to be afraid of. Passed with plenty of points to spare.

                    Every line you touch counts as one. Thats what had me nervous too. I thought you had to go end to end. Would have been no way to get a good score in 10 seconds.

                        DHS budget falls short on hiring CBP Officers, lawmaker says

                        The Homeland Security Department's proposed budget for fiscal year 2010 would provide funding to hire hundreds of new border and immigration agents and officers, but at least one lawmaker says that's not enough.

                        Rep. Loretta Sanchez, D-Calif., said the proposed $11.4 billion for Customs and Border Protection- which would represent a $162 million increase over this year- doesn't include enough money for hiring. While the department has focused on doubling the Border Patrol's ranks in recent years, it must hire more CBP officers to guard border crossings and airports, she said.

                        "I was greatly disappointed that the president's budget only included funding for 85 new CBP officers," Sanchez said at a June 11 hearing of the House Homeland Security subcommittee on border, maritime and global conterterrorism, which she claims chairs. "We must ensure that there is sufficient staffing at our nation's ports of entry, particularly given the expanding mission CBP officers have."

                        Meanwhile, Immigration and Customs Enforcement is slated to hire 1,200 new agents and other employees in fiscal 2010.

                          Is that 85 new officers total for 2010? or is it in addition to the hundreds hired each year?

                            • I got the call for S.F/Oak

                              Good news everyone, today at 1pm I got the call for S.F/Oak. Unfortunately I was working and missed the call. However they left a voice mail and I called them back later on during the day and of course no answer. I left a message saying that I would take the job offer. Looks like I’ll be calling them in the morning. I’ll keep everyone posted.

                                Well thank god for good news. Congrats and good luck. That's a busy airport and you'll learn your trade real quick.
